1. Agreement
These Terms of Service ("Terms") govern your use of the Spektra desktop application ("Software") developed and distributed by Spektra ("we", "us", "our"). By purchasing or using the Software, you agree to these Terms.
2. License
When you purchase Spektra, we grant you a personal, non-exclusive, non-transferable license to install and use the Software on up to three (3) devices that you own or control.
You may not:
- Redistribute, sublicense, or resell the Software
- Reverse engineer, decompile, or disassemble the Software
- Remove or alter any proprietary notices or labels
- Use the Software for any unlawful purpose
3. Purchase & Payment
Spektra is sold as a one-time purchase through our payment processor, Lemon Squeezy (Lemon Squeezy, LLC). All payment processing, billing, and tax collection is handled by Lemon Squeezy as the Merchant of Record. By completing a purchase, you also agree to Lemon Squeezy's Terms of Service.
4. Updates
Your license includes free updates for the major version you purchased (e.g., all V1.x releases). Future major versions may require a separate purchase at our discretion.
5. Refunds
We offer a 30-day money-back guarantee. See our Refund Policy for details.
6. Intellectual Property
The Software, including its code, design, branding, and documentation, is owned by Spektra and protected by applicable copyright and intellectual property laws. Your purchase grants a license to use the Software — it does not transfer ownership of any intellectual property.
7. Your Content
Spektra analyzes audio files stored locally on your device. We do not access, collect, upload, or claim any rights to your music library or any data generated by the Software. Your files remain entirely yours.
8. Disclaimer of Warranties
The Software is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Software will be error-free, uninterrupted, or compatible with all hardware or operating system configurations. Your use of the Software is at your sole risk.
9. Limitation of Liability
To the maximum extent permitted by law, Spektra shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software. Our total liability shall not exceed the amount you paid for the Software.
10. Termination
We may terminate your license if you violate these Terms. Upon termination, you must stop using and delete all copies of the Software. Sections 6, 8, 9, and 11 survive termination.
11. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the State of Florida.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via our website. Continued use of the Software after changes constitutes acceptance of the revised Terms.
